"COURT OF CRIMINAL JURISDICTION.
On Monday the Court re-assembled (per adjournment) and proceeded to the trial of the following persons ...
John McNeale for stealing out of a house of Mr. Robert Campbell two half casks, and two quarter casks of gunpowder, and
Arthur Martin for receiving knowing the same to have been stolen.
Mr. R. Campbell jun. deposed that on the morning of the 3d of May ult. he received information of the staple of the building in which the powder was kept being drawn; in consequence whereof he examined and discovered that the above quantity had been stolen; that he was afterwards present when a bag containing about 30lb of powder was found in the house of Arthur Martin, concealed behind a chest; which exactly corresponded with a sample produced. The deponent also stated that the prisoner McNeal was in the employ of Mr. Robert Campbell as a watchman.
Mr. Redmond, chief constable, deposed, that in consequence of an information he searched the house of Martin upon the 4th of May, and found therein a bag containing about 30lbs of powder, and a jar in a back room containing about 130 lbs. more.
Cornelia Cochrane, who cohabited with Martin, being admitted King's evidence, deposed, that on the 29th of April the prisoner McNeal brought to the house of Martin four casks of powder; but denied any knowledge of its being taken out of the casks and put into the jar or bag.
The evidence for the prosecution here closed, and the prisoners being put on their defence, they both denied the charge; after which the Court cleared; and on to opening both were found guilty.
John McNeal, Death. Arthur Martin (being a prisoner for life), to receive 500 lashes, and to be kept to labour in the gaol gang until an opportunity shall offer of sending him to the Southward.
