John was tried at Devon Lent Assizes held at Exeter Castle on Monday 14 Mar 1785. "Stephen Davenport, John Herbert, Robert Ellwood and John Small: For feloniously assaulting James Burt in the King's Highway feloniously putting him in corporal fear and danger of his life...and feloniously and violently taking from his person and against his will in the said highway, one metal watch and Tortoiseshell case value 30s. one pruning knife value 6d. and five shillings his goods." They were found guilty and sentenced to be hanged. Royal mercy extended on Herbert and Small to transportation for seven years. John was transported aboard the ship Charlotte

"...The humble petition of John Small a constable and settler at Kissing Point
Most humbly sheweth
That Your Excellency's petitioner begs to state he has been in this colony upwards of twenty years has a large family a wife and seven children, which he has supported by extensive industry, that in consequence of his land being nearly exhausted by constant tilage, His Honor Lieutenant Governor Paterson was pleased to grant him thirty acres more and that it was further His Honor's intention to have given petitioner another addition had His Honor remained in the command.
That petitioner humbly hopes Your Excellency will in your goodness confirm his said grant and that as he can refer to Colonel Paterson and most of the Officers for a character he is induced respectfully to hope that on a future day he may cherish an [illegible] for some further indulgence from Your Excellency in [illegible] he flatters himself he will find a protector to his large family and his best endeavours shall he exerted to [illegible] the approbation of Your Excellency by a continuance of the [illegible] of conduct which he has hitherto practiced.
