Text: John was tried at Devon Lent Assizes held at Exeter Castle on Monday 14 Mar 1785. "Stephen Davenport, John Herbert, Robert Ellwood and John Small: For feloniously assaulting James Burt in the King's Highway feloniously putting him in corporal fear and danger of his life...and feloniously and violently taking from his person and against his will in the said highway, one metal watch and Tortoiseshell case value 30s. one pruning knife value 6d. and five shillings his goods." They were found guilty and sentenced to be hanged. Royal mercy extended on Herbert and Small to transportation for seven years. John was transported aboard the ship Charlotte |
